Alexander v. Warner
Decision Date | 19 October 1900 |
Citation | 58 S.W. 700 |
Parties | ALEXANDER v. WARNER. [1] |
Court | Kentucky Court of Appeals |
Appeal from circuit court, Hopkins county.
"Not to be officially reported."
Action by J. P. Alexander against J. P. Warner. Judgment for defendant, and plaintiff appeals. Dismissed.
J. P. Alexander, for appellant.
Laffoon & Dempsey, for appellee.
The sum sought to be recovered is less than $200. The minimum sum which gives this court jurisdiction is $200, as provided in the act of March 14, 1898 (Acts 1898, p. 71). The judgment appealed from was rendered on February 25, 1898. The appeal was granted by the clerk of this court on January 10, 1899. So the act of 1898, supra, was in force when the appeal was granted. The law in force at the time the appeal is granted by the clerk regulates the jurisdiction of the court. Therefore this court has no jurisdiction of this appeal. Frost v. Rowan, 56 S.W. 427. The appeal is dismissed.
