This is an action under the Workmen's Compensation Act (Rev. St. 1929, § 3299 et seq.). Plaintiff is the widow of Wright Allison, who, while in the employ of the defendant Eyermann Construction Company, met with an accident which resulted in his death. Plaintiff sues for the death benefit under the Compensation Act. Defendant Fidelity & Casualty Company is the insurer of the Eyermann Construction Company against liability as an employer.

The Compensation Commission awarded plaintiff for death benefit $10.61 per week for 300 weeks, less amount previously paid. From this award, defendants appealed to the circuit court. From the judgment of the circuit court, affirming the award of the commission, defendants have appealed to this court.

This appeal presents but one issue. Defendants concede that plaintiff is entitled to the death benefit, but insist that the award is excessive. They concede that she is entitled to an award of $9.24 per week, but contend that there is not sufficient evidence in the record to warrant an award for $10.61, or for any sum in excess of $9.24, per week.

The Compensation Act (Section 3320, R. S. 1929), provides as follows:

"(c) If the injured person has not been engaged in the employment of the same employer for the full year immediately preceding the accident, the compensation shall be computed according to the annual earnings which persons of the same class in the same employment and same location (or if that be impracticable, of neighboring employments of the same kind) have earned during such period.

"(d) As to employees in employments in which it is the custom to operate throughout the working days of the year, the annual earnings, if not otherwise determinable, shall be regarded as 300 times the average daily earnings in such computation.

"(e) As to employees in employments in which it is the custom to operate for a part of the whole number of working days in each year, such number, if the annual earnings are not otherwise determinable, shall be used instead of 300 as a basis for computing the annual earnings: Provided, the minimum number of days which shall be so used for the basis of the year's work shall be not less than 200."
