Appeal from Supreme Court, Appellate Division, First Department, 23 A.D.2d 830, 259 N.Y.S.2d 396.
An action in libel was filed.
The Supreme Court, Special Term, New York County, Arthur G. Klein, J., denied defendants' motion to dismiss the complaint for failure to state cause of action, and defendants appealed.
The Appellate Division held that a letter stating that insurance company's agent knew of defendant finance company's interest but neglected or refused to properly represent such company's interest in an insurance policy was not actionable on its face and so was not actionable without the pleading of special damages. The order was reversed on the law, and motion to dismiss was granted. The plaintiff appealed to the Court of Appeals.
