Appeal from Supreme Court, Appellate Division, First Department, 16 A.D.2d 917, 229 N.Y.S.2d 168.
Plaintiff automobile dealer brought action against former employee and defendant dealer for breach of restrictive covenant in employment contract between plaintiff dealer and former employee and for damages.
The Supreme Court, Bronx County, entered a judgment for the plaintiff dealer after the Appellate Division by interlocutory judgment reversed a judgment of the Supreme Court, Special Term, Bronx County, dismissing the complaint, and the defendant dealer and former employee appealed.
The Appellate Division modified the judgment by reducing the amount of the judgment and held that ascertainable overhead expenses of defendant dealer in selling automobiles should have been deducted in assessing damages to be awarded plaintiff dealer. The defendant dealer and former employee appealed to the Court of Appeals, and the plaintiff dealer cross-appealed.
