ORDER
On order of the Court, defendant-appellant's application for leave to appeal having been ordered held in abeyance pending decision in Cassidy v. McGovern (Docket No. 65385) and Hermann v. Haney (Docket No. 65753), and said decision having been issued on December 23, 1982, 415 Mich. 483, 330 N.W.2d 22.
Now, therefore, the said application is hereby considered and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal, we MODIFY the judgment of the Court of Appeals, 105 Mich.App. 556, 307 N.W.2d 89 (1981), in the following respect: On remand, the circuit court is directed to proceed in the manner outlined by this Court in Cassidy v. McGovern and Hermann v. Haney.
