The first count in the indictment was as follows "The jurors for the commonwealth of Massachusetts on their oath present that Francis X. Blanchette of Fall River in the county of Bristol, on the 18th day of December, in the year of our Lord one thousand eight hundred and ninety-one at Fall River, in the county of Bristol, being a person of an evil disposition, and devising and intending by unlawful ways and means to obtain and get into his hands and possession the goods, merchandise, chattels, and effects of the honest and good citizens of this commonwealth, and with intent to cheat and defraud David Hollingworth, and to induce the said David Hollingworth to deliver to him the goods, wares, and merchandise hereinafter set forth, did then and there unlawfully, knowingly, and designedly falsely pretend and represent to the said David Hollingworth that he, the said Francis X. Blanchette, then and there had a shop in the town of Warren, in the state of Rhode Island, and that he, the said Francis X. Blanchette, was then proprietor and keeper of a shop which was then being carried on by him, the said Francis X. Blanchette, for the sale of goods at retail at Warren, in the state of Rhode Island, and that he, the said Francis X. Blanchette, wished to purchase of the said David Hollingworth the goods, wares, and merchandise hereinafter set forth, to be sent to the said shop so as aforesaid, then being kept and carried on by him, the said Francis X Blanchette, in Warren, in the state of Rhode Island, as aforesaid, to be sold by him, the said Francis X. Blanchette in said shop in the ordinary course of trade. And the said David Hollingworth, then and there believing the said false pretenses and representations so made as aforesaid by the said Francis X. Blanchette, and being deceived thereby, was induced, by reason of the false pretenses and representations so made as aforesaid, to deliver, and did then and there deliver, to the said Francis X. Blanchette, two hundred pounds of butter, of the value of forty dollars, forty pounds of cheese, of the value of four dollars, three hundred and sixty eggs, of the value of seven dollars, thirty-four pounds of tea, of the value of seven dollars, and seventy-five pounds of soap, of the value of four dollars, of the proper goods, merchandise, chattels, and effects of said David Hollingworth; and the said Francis X. Blanchette did then and there receive and obtain the said goods, merchandise, chattels, and effects of the said David...
