Appeal from Supreme Court, Appellate Division, Third Department, 4 A.D.2d 801, 164 N.Y.S.2d 686.

Actions were brought by landowners against the Power Authority of the State of New York and the Superintendent of Public Works of the State of New York, to enjoin the Power Authority from taking land of landowners.

The Supreme Court, Special Term, St. Lawrence County, Paul D. Graves, J., 4 Misc.2d 879, 163 N.Y.S.2d 902, entered orders and judgments dismissing the complaints, and the landowners appealed.

The Appellate Division, 4 A.D.2d 801, 164 N.Y.S.2d 686, affirmed the orders and judgments and held that land forming an island within power pool and lands directly adjoining pool could be taken by Power Authority in order to protect project properly.

The landowners appealed to the Court of Appeals, contending that proposed condemnation of lands of landowners for purposes unrelated to commerce, navigation, or hydroelectric power is ultra vires, and proposed condemnation of the lands for private purposes is a violation of the Fourteenth Amendment of the federal Constitution and Article 1, Sections 6 and 7 of the state Constitution.
