There was no abuse of discretion in granting a first new trial in this case.

Error from superior court, Greene county; H. McWhorter, Judge.

Action by H. T. Lewis, executor and trustee, against Charles J. Doherty and another for directions under a will as to claims against the estate. There was judgment disallowing a certain claim, and from an order granting a new trial defendants bring error. Affirmed.
