Nixon, Hargrave, Devans & Doyle, Rochester, for appellants (Casper V. Baltensperger, Rochester, of counsel).

Winchell, Goldwater & Connors, Rochester, for respondents (Charles A. Hall, Rochester, of counsel).

MEMORANDUM.

It is not clear that the plaintiff cannot recover from the defendant Rochester Gas & Electric Corporation on the basis of passive negligence. That being so, the second cause of action in the third party complaint was improperly dismissed as insufficient in law. This is particularly so when the cause of action which was dismissed is viewed in the light of Sections 3013 and 3017(a) of the CPLR. See also Note, Weinstein's New York Civil Practice, Vol. 3, para. 3013.03, and also Foley v. D'Agostino, 21 A.D.2d 60, 248 N.Y.S.2d 121.

Order unanimously reversed without costs, and motion denied without costs.
