Error to circuit court, Belmont county.

Action under Rev. St. § 4364, by one Dugan against one Neville, to subject land to the payment of damages caused by illegal sales of liquor by a lessee. Judgment for plaintiff. Defendant brings error. Affirmed.

PER CURIAM.

This cause was advanced, and heard with the preceding one,-Mullen v. Peck, 31 N.E. 1077. The questions involved are those embraced in the first and third paragraphs of the syllabus in the Mullen Case, and were determined by the court below in accordance with our decision in that case.

The judgment is therefore affirmed.
