PartiesRichard ESPOSITO, et al., Plaintiffs, v. BOB IKO EXCAVATION, Defendant Third-Party Plaintiff-Respondent; Yellow Freight System, Inc., Third-Party Defendant-Appellant. . Supreme Court of New York, Appellate Division, Second Department
CourtNew York Supreme Court — Appellate Division

McCabe & Mack, LLP, Poughkeepsie, N.Y. (Elizabeth R. Baum of counsel), for third-party defendant-appellant.

Thomas M. Bona, P.C., White Plains, N.Y. (James C. Miller of counsel), for defendant third-party plaintiff-respondent.

In an action to recover damages for personal injuries, etc., the third-party defendant Yellow Freight System, Inc., appeals from an order of the Supreme Court, Orange County (Murphy, J.), dated July 2, 1997, which denied its motion to dismiss the third-party complaint.

ORDERED that the order is affirmed, with costs.

The Supreme Court properly concluded that the Omnibus Workers' Compensation Act of 1996 (L.1996, ch. 635, § 2) is inapplicable under the circumstances presented, i.e., where the main action was pending at the time that statute became effective but the third-party action was commenced shortly thereafter (see, Majewski v. Broadalbin-Perth Cent. School Dist., 91 N.Y.2d 577, 590, 673 N.Y.S.2d 966, 696 N.E.2d 978; cf., Morales v. Gross, 230 A.D.2d 7, 657 N.Y.S.2d 711; see also, Maher v.
