ORDER

On order of the Court, the certification by the Court of Appeals pursuant to Administrative Order 1984-2 that its decision in this case conflicts with its decision in Toth v. Goree, 65 Mich.App. 296, 237 N.W.2d 297 (1975), lv. den. 396 Mich. 836 (1976) and the application for leave to appeal are considered. Pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals and REINSTATE the judgment of the trial court. We do not find any basis in the legislative history or in the case law of this state to conclude that the Legislature intended to create a cause of action for a nonviable fetus not born alive when it enacted and later amended the Wrongful Death Act. We agree with the dissent in the Court of Appeals that any decision to extend liability under the Wrongful Death Act is one more appropriately left to the Legislature.
