PartiesBarney M. GILES and Roy Glennan v. CITY OF BILOXI, Mississippi et al.
CourtMississippi Supreme Court

Appeal from Chancery Court, Harrison County; Wm. G. Hewes, Special Chancellor.

On suggestion of error. For former opinion see 112 So.2d 815.

Arnaud Lopez, Howard A. McDonnell, Biloxi, for appellant.

Thos. J. Wiltz, Biloxi, Satterfield, Shell, Williams & Buford, Jackson, for appellee.

McGEHEE, Chief Justice.

We have carefully studied and considered the suggestion of error and the brief in support thereof in this case and we have concluded to adhere to our opinion rendered in this cause on June 8, 1959, and our conclusion in this behalf is strengthened by the views of the Supreme Court of Florida in the case of City of West Palm Beach, Florida v. State of Florida, 113 So.2d 374. That case likewise involved the proposed issuance of revenue bonds instead of full faith and credit bonds to finance the project there involved.

Suggestion or error overruled.

All justices concur.
