Appeal from Supreme Court, Appellate Division, First Department, 13 A.D.2d 939, 216 N.Y.S.2d 756.
The guardian ad litem of an infant filed an application for leave to the infant to file a notice of claim for personal injury nunc pro tunc on the New York City Housing Authority pursuant to Section 50-e of the General Municipal Law, Consol.Laws, c. 24.
The Supreme Court, Special Term, Bronx County, Amsterdam, J., rendered an order granting the application, and the New York City Housing Authority appealed.
The Appellate Division reversed the order and held that failure to file notice within statutory time, due to inadvertence of counsel, was not by reason of disability of infancy within statute permitting court to grant leave to serve a late notice of claim where the claimant is an infant and by reason of such disability fails to serve timely notice. Eager and Stevens, JJ., dissented in part.
The guardian ad litem appealed to the Court of Appeals, contending that the Special Term properly granted the infant's motion to file a notice of claim nunc pro tunc.
