This is a companion case to Greer v. St. Louis Public Service Company (No. 23492) 87 S.W.(2d) 240, the opinion in which is handed down herewith. That case represents the appeal of defendant Ward & Mack Transfer Company, and this the appeal of defendant St. Louis Public Service Company, but both from one and the same judgment which was rendered against the two defendants jointly in the circuit court of the city of St. Louis, and from which each defendant thereafter took and perfected its separate appeal to this court.

By stipulation of counsel for the respective parties to this appeal, it is agreed that the same shall abide the decision rendered in the companion case No. 23492 as handed down herewith.

It follows, therefore, that as to defendant St. Louis Public Service Company the judgment rendered by the circuit court should likewise be affirmed; and the Commissioner so recommends.

The foregoing opinion of BENNICK, C., is adopted as the opinion of the court.

The judgment of the circuit court is, accordingly affirmed.
