The above entitled cause is retransferred to the Court of Appeal, First District, Division Two, 151 Cal.Rptr. 895, for reconsideration in light of Price v. Civil Service Commission, 26 Cal.3d 257, 161 Cal.Rptr. 475, 604 P.2d 1365, and United Steelworkers v. Weber (1979) 443 U.S. 193, 99 S.Ct. 2721, 61 L.Ed.2d 480.

MOSK, CLARK, and RICHARDSON, JJ., are of the opinion that the cause should be retransferred to the Court of Appeal with directions to refile its original opinion.
