Appeal from Supreme Court, Appellate Division, First Department, 20 A.D.2d 849, 247 N.Y.S.2d 1002.
Tenants brought action against landlord for injuries inflicted on the tenants by an unidentified intruder, on ground that the landlord was negligent in constructing a concrete base, which housed part of chimney pipe, under window of living room of tenant, so that intruder could use the concrete base to gain access to window of tenants.
The Supreme Court, Trial Term, New York County, Arthur G. Klein, J., entered a judgment dismissing the complaint on the law and the facts, and the tenants appealed.
The Appellate Division unanimously affirmed the judgment without opinion.
The tenants appealed to the Court of Appeals.
