In overruling the motions for rehearing filed by each of the parties to this suit, we desire to say that if, upon another trial, judgment should go in favor of the state, it would not draw interest. This question was passed upon in M., K. & T. Ry. Co. v. State, 97 S. W. 724, 17 Tex. Ct. Rep. 24, 26. Both of the motions for rehearing are overruled.
