BLAND, J.

This is an appeal from an interlocutory judgment in partition in a suit involving certain real estate in Callaway county. There is no question but that under the provisions of section 12, art. 6, of the Constitution of the state, title to real estate is involved in this case and jurisdiction of the cause is in the Supreme Court. Section 2008, R. S. 1919; Dildine v. De Hart (Mo. App.) 225 S. W. 130; Hart v. Steedman, 98 Mo. 452, 11 S. W. 993; Case v. Mitzenburg, 109 Mo. 311, 314, 19 S. W. 40; State ex rel. v. Rombauer, 124 Mo. 598, 600, 28 S. W. 75; Musick v. K. C. S. & M. Rd. Co., 43 Mo. App. 326.

The cause is transferred to the Supreme Court.
