WISE, Presiding Judge.

In accordance with the Alabama Supreme Court's opinion in Ex parte Ingram, 51 So.3d 1119 (Ala.2010), we reverse the circuit court's judgment and remand this case to that court for proceedings that are consistent with the Alabama Supreme Court's opinion.

REVERSED AND REMANDED.
