Appeal from the Supreme Court, Appellate Division, First Department, 35 A.D.2d 248, 315 N.Y.S.2d 695.
Suit charging that defendant willfully conspired to publish and distribute for sale a libelous account of plaintiff's life, misrepresenting same as plaintiff's true autobiography, without her approval and consent. The Supreme Court, Special Term, New York County, Samuel A. Spiegel, J., denied motion of one defendant to dismiss and appeal was taken.
The Appellate Division reversed, holding that plaintiff's attorney's affidavit was insufficient to establish that movant committed a tortious act in New York so as to validate the service made upon him.
Order affirmed, with costs.
