Order reversed, without costs, and matter remitted to Supreme Court, New York County, with directions to dismiss the proceeding for mootness. We decline to exercise our discretion to retain jurisdiction despite mootness (see Matter of Hearst Corp. v. Clyne, 50 N.Y.2d 707, 718, 431 N.Y.S.2d 400, 409 N.E.2d 876) for the reasons that the City acknowledges the requirement to promulgate regulations pursuant to section 1105(b) of the New York City Charter and has promulgated regulations.
