PartiesMANN v. RUSSELL. [1]
CourtKentucky Court of Appeals

Appeal from circuit court, Breathitt county.

"Not to be officially reported."

Petition by James B. Mann against A. C. Russell, jailer, for a writ of habeas corpus. Judgment dismissing petition, and plaintiff appeals. Dismissed.

W. W. Vaughn, for appellant.

PAYNTER, C.J.

The appellant filed in the clerk's office of this court what purports to be a transcript of proceedings on a writ of habeas corpus, and entered a motion to docket and advance the appeal. This court has no jurisdiction of an appeal from the judgment of a judge of a circuit court refusing to discharge one on a writ of habeas corpus. Broadwell v. Com., 98 Ky. 15, 32 S.W. 141; Weddington v. Sloan, 15 B. Mon. 147. The appeal is dismissed.
