Appeal from Circuit Court, Jackson County; Harris Robinson, Judge.

Action by Thomas F. Meiyer against Kansas City. Judgment for the plaintiff was reversed by the Kansas City Court of Appeals, and case certified on the request of the dissenting judge to the Supreme Court. Judgment of the circuit court affirmed.

This case grew out of the same accident as the case of Boyd v. Kansas City (Mo. Sup.) 237 S. W. 1001, just decided. No points are made in this case not disposed of in that.

We think the judgment should be affirmed, but, for the reasons stated in the Boyd Case, the cause is transferred to the court in banc.
