This is a companion case to that of Mary L. Mitchell v. Newton County Bank et al., No. 3883, 282 S. W. 729, decided by this court at this term.

The opinion in that case is therefore adopted in this case. It is accordingly ordered that the judgment entered herein be reversed and remanded with directions that judgment be entered as prayed in plaintiff's petition.
