Appeal from Supreme Court, Appellate Division, First Department.

A libel action was brought for publication of a newspaper article stating that plaintiff, who was assistant corporation counsel, was suspended for compelling his staffers to buy $100 tickets for a Democratic dinner.

The Supreme Court, Special and Trial Term, New York County, Sidney A. Fine, J., entered a judgment for the plaintiff for only six cents, and the plaintiff appealed.

The Appellate Division unanimously affirmed the judgment.

The plaintiff appealed to the Court of Appeals, contending that instruction that everything which reporters were told or were shown at press conference was privileged was erroneous.
