Appeal, in each of the above-entitled actions, from a judgment, entered June 13, 1930 (229 App. Div. 211, 241 N. Y. S. 441), upon an order of the Appellate Division of the Supreme Court in the First Judicial Department, which reversed a judgment in favor of the defendant, entered upon a dismissal of the complaint by the court on trial at Special Term, and directed judgment in favor of plaintiff rescinding and canceling two policies of insurance upon the life of the defendant's father, in which the defendant was named as beneficiary, upon the ground that the insured, prior to his death, breached a condition precedent relating to consultations and treatment between the date of his medical examination and the date of the delivery of the policies and the payment of the first premiums thereon.Thomas G.
