ANDERSON, Justice.

The only question involved in this case of such merit as to require discussion by the court is the same question involved in the case of Eddie T. Lewis v. State of Mississippi, Miss., 195 So. 325.

The instruction in the present case is in all substantial respects the same as the instruction involved in that case, and the evidence for the State made the instruction applicable.

Affirmed.
