Appeal from Supreme Court, Appellate Division, Second Department, 7 A.D.2d 1007, 185 N.Y.S.2d 228.

Action was brought to enjoin construction of a church in alleged violation of restrictive covenants.

The Supreme Court, Westchester County, Elbert T. Gallagher, J., 13 Misc.2d 708, 172 N.Y.S.2d 95, rendered judgment dismissing the complaint, and the plaintiffs appealed.

The Appellate Division, 7 A.D.2d 1007, 185 N.Y.S.2d 228, unanimously affirmed the judgment without opinion.

The Appellate Division, 8 A.D.2d 629, 186 N.Y.S.2d 215, denied motion for leave to appeal to the Court of Appeals.

The plaintiffs appealed to the Court of Appeals.

Gordon Miller, White Plains, for appellants.

Judgment affirmed, with costs. The findings and conclusions that the deed to defendant did not impose the restriction on the subject property are sufficient in themselves to require affirmance of the judgment. We pass upon no other question.
