In a coram nobis proceeding, defendant appeals from an order of the Supreme Court, Kings County, dated October 9, 1963, which denied without a hearing his application to vacate a judgment of the former County Court, Kings County, rendered June 2, 1961 after a jury trial, convicting him of robbery and grand larceny (both in the first degree) and assault in the second degree, and resentencing him as a second felony offender to serve the same term he had been originally sentenced to serve on September 1i, 1947 as a third felony offender. The original judgment of conviction, rendered September 12, 1947, was affirmed by this court (273 App.Div. 977, 79 N.Y.S.2d 328). Order affirmed. No opinion.
