Prior report: 218 A.D.2d 584, 630 N.Y.S.2d 737.

MEMORANDUM.

The order of the Appellate Division should be affirmed.

The grounds defendant now advances for challenging the lawfulness of the search were not presented to the trial court. We therefore conclude that defendant failed to preserve his present claims for this Court's review.

KAYE, C.J., and SIMONS, TITONE, BELLACOSA, SMITH, LEVINE and CIPARICK, JJ., concur.

Order affirmed in a memorandum.
