ORDER

The Court of Appeals decision dated March 14, 1983, the Court of Appeals record, and the trial court record have been considered by the Court, pursuant to a letter request of the defendant under Administrative Order 198304, 417 Mich cxxii, to determine whether leave to appeal or other relief should be granted by this Court.

On order of the Court, the request is treated as an application for leave to appeal and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal, we VACATE the Court of Appeals' judgment and REMAND this case to the Court of Appeals for reconsideration in light of People v. Robideau, 419 Mich. 458, 355 N.W.2d 592 (1984).
