On order of the Court, the request is treated as an application for leave to appeal and, pursuant to GCR 1963, 853.2(4), in lieu of granting leave to appeal, we VACATE the Court of Appeals' judgment and REMAND this case to the Court of Appeals for reconsideration in light of People v. Robideau, 419 Mich. 458, 355 N.W.2d 592 (1984).
