Disposition: Leave to appeal was held in abeyance pending the decision in the cases of People v. Banks (Docket No. 101601), People v. Tucker (Docket No. 103191), and People v. DeNio (Docket No. 105328).

The decision having been issued on June 17, 1997, 454 Mich. 691, 564 N.W.2d 13 (1997), application for leave to appeal is again considered, and, pursuant to MCR 7.302(F)(1), in lieu of granting leave to appeal, we REVERSE the judgment of the Court of Appeals and REMAND this case to the Court of Appeals for reconsideration in light of People v. Denio, 454 Mich. 691, 695, 706, n. 16, 564 N.W.2d 13 (1997).
