Appeal, by permission, from a judgment of the Broome County Court, entered May 29, 1935 (156 Misc. 870, 283 N. Y. S. 531) which affirmed a judgment of the Court of Special Sessions in the town of Chenango rendered upon a verdict convicting the defendant of a violation of subdivision 3 of section 106 of the Alcoholic Beverage Control Law (Consol. Laws, c. 3-B). The information charged that on or about January 13, 1935, the defendant, being licensed to sell alcoholic beverages for consumption on premises at the Dixie Inn, sold and delivered and caused to be sold and delivered at said Dixie Inn a pint of liquor for consumption off the premises where sold.
