Appeal from Supreme Court, Erie County.
Defendant was convicted of first degree murder. The Supreme Court, Erie County, Carlton A. Fisher, J., entered judgment, and the defendant appealed.
The Court of Appeals, 5 N.Y.2d 766, 179 N.Y.S.2d 859, granted application for assignment of counsel and assigned John I. O'Day, and Edward K. O'Shea, as counsel for the defendant on the appeal, and granted motion for enlargement of time and set the case down for argument during the January, 1959, session of the Court of Appeals.
The Court of Appeals, 5 N.Y.2d 871, 182 N.Y.S.2d 21, granted another motion for enlargement of time and set the case down for argument during the February, 1959 session of the Court of Appeals.
The Court of Appeals, 5 N.Y.2d 1005, 185 N.Y.S.2d 262, granted motion for a further enlargement of time and set the case down for argument during the April, 1959 session of the Court of Appeals.
