Appeal from Supreme Court, Appellate Division, First Department.

The defendant, who was president of the Borough of Manhattan, was convicted of violating the conflict of interest provision of the New York City charter.

The Court of General Sessions in the City of New York, Sarafite, J., rendered judgment, and the defendant appealed.

The Appellate Division unanimously affirmed the judgment.

The defendant appealed to the Court of Appeals, contending that the Court of General Sessions erroneously interpreted the city charter, and that the defendant, who committed to crime knowingly, could not be held guilty of conspiracy to obstruct justice.
