Determination of the appeal withheld and the case as to defendant Louis remitted to the Supreme Court, Bronx County, for further proceedings consistent with People v. Huntley, 15 N.Y.2d 72, 255 N.Y.S.2d 838, 204 N.E.2d 179, decided herewith.

All concur except VAN VOORHIS, J., who dissents upon his dissenting opinion in People v. Huntley, decided herewith, in which SCILEPPI, J., concurs.
