Appeal by defendant from a judgment of the County Court, Nassau County, rendered June 30, 1964, convicting him of burglary in the third degree, upon a jury verdict, and imposing sentence. Pursuant to an order of this court dated March 8, 1965 (People v. Moore, 23 A.D.2d 670, 258 N.Y.S.2d 346) the action was remitted to the trial court for a Huntley type hearing and the appeal has been held in abeyance. Such hearing has been had, following which the County Court made an order, entered June 25, 1965, finding that the confession admitted into evidence at the trial had been voluntary. Judgment affirmed. No opinion.
