An appeal having been taken from a judgment of the Supreme Court, New York County, rendered on or about October 15, 2018, and this Court having previously remanded this matter to Supreme Court for a Frye hearing and having held the appeal in abeyance for that purpose (see, People v Patterson, 204 A.D.3d 548 [1st Dept 2022]), And the People having moved to lift the abeyance, reverse the judgment of conviction and remand to Supreme Court, Now, upon reading and filing the Second Notice of Change in Circumstance of the People, dated August 18, 2022, and due deliberation having been had thereon, It is ordered that the motion is withdrawn in accordance with the aforesaid Notice.
