In the above entitled action, this court by order dated April 9, 1984, 100 A.D.2d 366, 474 N.Y.S.2d 767, affirmed a judgment of the Supreme Court, Kings County, (Kooper, J.) rendered July 28, 1978 and by order dated May 22, 1984 reargument was granted and upon reargument, the original decision was adhered to, and appellant having made an application to me, as a Justice of this court, for a certificate granting leave to appeal to the Court of Appeals from this court's orders (CPL 460.20; CPL 460.10, subd. 5), it is ORDERED that the application is hereby granted; and it is hereby certified that the case involves a question of law which ought to be reviewed by the Court of Appeals..
