Appeal from Supreme Court, Appellate Division, Third Department, 29 A.D.2d 192, 287 N.Y.S.2d 118.

Certain searches and seizures were made pursuant to search warrants.
The County Court of Schenectady County, Archibald C. Wemple, J., 49 Misc.2d 677, 268 N.Y.S.2d 677, rendered an order declaring the searches and seizures illegal and void.
The Appellate Division, Staley, J., 29 A.D.2d 192, 287 N.Y.S.2d 118, affirmed the order and held that search warrants were illegal and void for failure to comply with Section 794 of the Code of Criminal Procedure providing that person seeking warrant shall appear personally before the judge, in view of fact that applicants for warrants did not appear before issuing justice. Herlihy, J.P., dissented.
The People of the State of New York appealed to the Court of Appeals.
Order affirmed on the opinion at the Appellate Division,
All concur except SCILEPPI and JASEN, JJ., who dissent and vote to reverse on the dissenting opinion at the Appellate Division.
