Appeal from the Supreme Court, Appellate Division, Second Department, 38 A.D.2d 892, 329 N.Y.S.2d 1010.

Defendant was convicted in the Supreme Court, Kings County, Aaron E. Koota, J., of manslaughter in the first degree and he appealed.

The Appellate Division affirmed and appeal was by permission of the Chief Judge.

In the Court of Appeals, defendant contended that trial judge's exclusion of public during testimony of 16-year-old prosecution witness who had been spoken to by defendant and his friends deprived him of a public trial.

Order affirmed.

All concur.
