The motion to waive fees is GRANTED for this case only.

Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal, the January 24, 2022 order of the Kalamazoo Circuit Court is VACATED. The circuit court erred when it returned defendant's successive motion for relief from judgment. MCR 6.502(G)(2); People v Stovall, 334 Mich.App. 553, 560-561; 965 N.W.2d 264 (2020). Defendant shall refile his motion. The circuit court shall accept the motion for filing and address the merits of the arguments raised in the motion. This order has immediate effect. MCR 7.215(F)(2). The Court does not retain jurisdiction.
