Bernard C. Smith, Dist. Atty., Riverhead, for respondent; Lawrence J. Bracken, Riverhead, of counsel.

Appeal by defendant from a judgment of the County Court, Suffolk County, rendered May 20, 1964 after a jury trial, convicting him of rape, attempted robbery and grand larceny (all in the first degree) and of carrying and use of a dangerous weapon, and imposing sentence. Pursuant to this court's order (22 A.D.2d 927, 255 N.Y.S.2d 507), a separate hearing was held by the court upon the issue of the voluntariness of the defendant's confession. The court's finding that the confession was voluntary has been reviewed together with all other issues raised by the defendant. Judgment affirmed. No opinion.
