An order of this Court having been entered on March 23, 2023 (Motion No. 2023-00711), inter alia, granting defendant's motion for leave to prosecute, as a poor person, the appeal taken to this Court from a judgment of the Supreme Court, Bronx County, rendered on or about January 13, 2023, under Indictment No. 71641/22, and assigning counsel therefor, and said appeal having been perfected, And defendant-appellant having moved for an order amending the notice of appeal and the aforementioned order of this Court to include an appeal from a judgment of resentence of the Supreme Court, Bronx County, rendered on or about December 08, 2023, and related relief, Now, upon reading and filing the papers with respect to the motion, and due deliberation having been had thereon, It is ordered that the motion is granted to the extent of deeming the moving papers a timely filed notice of appeal from the judgment of resentence rendered on or about December 08, 2023, amending the aforesaid order of assignment to include said judgment of resentence, extending the poor person relief previously granted to cover same, granting defendant permission to withdraw his previously filed brief so that he may address both judgments on appeal, and extending the time to perfect the appeals until 180 days after receipt of the complete record.
