Appeal from Supreme Court, Appellate Division, First Department, 8 A.D.2d 161, 186 N.Y.S.2d 848.

Defendants were convicted of violating the Multiple Dwelling Law, Consol.Laws, c. 61-a, § 1 et seq., and the Sanitary Code of the City of New York. The Magistrate's Court of the City of New York, Borough of Manhattan, sitting as Court of Special Sessions, Richman, Magistrate, entered judgments, and the defendants appealed.

The Appellate Division affirmed the judgments and held that under the circumstances the sentences were not excessive.

The defendants appealed to the Court of Appeals, and motion was made in the Court of Appeals for an order consolidating the appeals and for enlargement of time, and motion was made in the Court of Appeals to have the appeals heard on the original records.

The Court of Appeals, 7 N.Y.2d 731, 193 N.Y.S.2d 477, granted motion for an order consolidating the five appeals and for enlargement of time, and set the case down for argument during the November, 1959 session of the Court of Appeals, and denied motion to have the appeals heard on the original records without prejudice to renewal thereof on a proper showing made in affidavits.

Motion was made in the Court of Appeals for further enlargement of time.

Motion for enlargement of time granted and the case set down for argument during the March, 1960, session of this Court.
