This cause comes to this court by appeal from an order of the trial court sustaining motion for new trial.The cause of action in this cause is thus stated in the petition: The answer was a general denial and plea of contributory negligence.As this is an appeal from an order sustaining motion for new trial, and the record discloses that the action of the court is predicated solely upon the ground that the instructions were erroneous, we see no reason for burdening this opinion with a statement of the evidence, and it is sufficient for the purpose of disposing of the legal propositions involved, to say that there was testimony by both parties tending to establish the issues presented in the pleadings.
At the close of the evidence the court instructed the jury as follows:
