Appeal, by permission, from a judgment of the Appellate Division of the Supreme Court in the Second Judicial Department (237 App. Div. 62, 260 N. Y. S. 323), entered November 25, 1932, unanimously affirming a judgment in favor of plaintiff entered upon a verdict in an action to recover for personal injuries alleged to have been sustained by plaintiff through the negligence of the defendant. The plaintiff, a boy eleven years of age, while acting as a caddy, but not on behalf of the defendant or any member of his party, was struck over the eye by a golf ball driven by defendant. When defendant drove off, he did not give any warning, but after the ball was in flight and he saw that it was going toward the plaintiff, he shouted, ‘Fore.’ The Appellate Division held that the jury was justified in finding that defendant did not use reasonable care.
