Application by the state, on the relation of Lawrence M. Walsh, for writ of mandamus to Arthur V. Offill, county clerk. Writ granted.H. M. Sinclair, for plaintiff.
Fawcett & Abbott, amicus curiæ. Edwin E. Squires, Norris Brown, Atty. Gen., and W. T. Thompson, Dep. Atty. Gen., for defendant.
This is an original application for a writ of mandamus against the county clerk of Buffalo county, and the questions presented upon the record are in all respects identical with those presented in State v. Plasters (Neb.) 105 N. W. 1092.
For the reasons given in that case, a peremptory writ of mandamus was allowed.
I dissent for the reasons stated in my opinion in State ex rel. Hensley v. Plasters, supra.
