CRIMINAL LAW-INSUFFICIENCY OF EVIDENCE.
Where evidence was manifestly insufficient to sustain conviction for burglary in first degree, judgment will be reversed and case remanded.

Judgment of conviction of burglary. Reversed and remanded.

The appellate court cannot and will not shift the responsibility to the jury, but will examine the evidence to ascertain whether or not the verdict is supported by the evidence. (State v. If the proof fails to establish either of the elements of the crime necessary to constitute the crime charged, the verdict and judgment of conviction thereon will be set aside. (State v. John Drew and Earl Manion, together with William Hammond, were convicted of burglary in the first degree, and Drew and Manion have appealed. The evidence is manifestly insufficient to sustain the verdict. The judgment is, therefore, reversed and the case remanded.
